Unfortunately, after two months of waiting since the government was served, the government’s lawyer filed a motion to dismiss. Today, as I had anticipated, the judge granted the motion. While I recognize the unpredictability of these cases, it’s disappointing that, despite their high fees, the outcome was not in my favor. I just wish they—or any immigration lawyer—would be more honest about the reality of this type of lawsuit. It usually doesn’t work unless the embassy or USCIS decides to act on their own accord. If they don’t, you’ll end up stuck in the full legal process with no real progress. Additionally, they shouldn’t give false hope when the defendant’s lawyer files a motion to dismiss, because from my experience and conversations with others, that typically means the judge will grant the motion in most cases.
